These Terms of Use ("Terms") govern your access to and use of the Caliber mobile application and web portal (together, the "Service"), operated by Caliber App ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
By logging in to or otherwise using the Service, you confirm that you are at least 18 years old and that you have the authority to accept these Terms on your own behalf and, where applicable, on behalf of the organisation that authorised your access.
Caliber is a multi-organisation evaluation and scoring platform. Access is provisioned by your organisation: an administrator registers you as a user and assigns your role (instructor, supervisor, admin, or org-owner). The features available to you depend on the role your organisation assigns. We provide the Service to organisations and their authorised users; we do not offer self-registration to the general public.
The mobile app authenticates instructors and supervisors using phone-number verification (SMS one-time password). The web portal authenticates owners, org-owners, and admins using Google Sign-In. You are responsible for:
You agree to use the Service only for its intended evaluation and scoring purposes, in accordance with your organisation's instructions and applicable law. You agree not to:
Evaluation data โ including candidate scores, game results, and assessment comments โ is collected and processed on behalf of the organisation that authorised your access. Your organisation, not you individually, owns and controls this data and is responsible for how it is used. When you enter or submit data through the Service, you do so on your organisation's behalf. Each organisation's data is isolated, and access is limited to that organisation's authorised users.
The Service, including its software, design, and content (excluding organisation data), is owned by Caliber App and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. No other rights are granted.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect information. By using the Service, you acknowledge that you have read the Privacy Policy.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data will be free from loss or corruption.
To the maximum extent permitted by law, Caliber App shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service. Your organisation remains responsible for backing up and safeguarding its own evaluation data.
Your access depends on your organisation maintaining an active account and on your continued authorisation by that organisation. We or your organisation may suspend or terminate your access at any time, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Israel.
